The Court of Appeal had on Tuesday, in a majority decision, ruled that Dr Kidero’s challenger during the 2013 gubernatorial election, Ferdinand Waititu had raised sufficient grounds to have the results nullified.
Dr Kidero however rushed to the Supreme Court on Wednesday to file a petition to appeal the ruling.
The Supreme Court granted his request and stayed (suspended) the ruling by the Court of Appeal that had nullified his election pending determination of the appeal.

The Supreme Court also issued an order restraining the Independent Election and Boundary Commission (IEBC) from declaring the seat vacant until the appeal is determined.
Dr  Kidero filed the petition at the Supreme Court through lawyer Tom Ojienda.
